Terms of Service

1. Service Description

RooferFuel.ai provides AI-powered appointment generation and marketing automation services for roofing contractors. Our platform includes lead capture, appointment booking, review management, and digital marketing tools designed specifically for the roofing industry.

2. Eligibility

RooferFuel.ai services are available exclusively to licensed roofing contractors in good standing, distributed through Richards Building Supply. By using our services, you represent that you are a licensed roofing contractor operating within the Richards Building Supply service area.

3. Pricing and Payment

Our pricing structure includes:

• A one-time $997 activation fee due at signup
• Monthly base fees varying by tier (Ignite: $697, Burn: $997, Blaze: $1,297)
• Per-qualified-appointment fees varying by tier (Ignite: $400, Burn: $300, Blaze: $200)

Payment is due on the first of each month. We accept major credit cards and ACH transfers.

4. 90-Day Activation Period

All subscriptions include a 90-day activation period during which the full service is deployed and optimized for your business. After the activation period, your subscription continues on a month-to-month basis. You may cancel with 30 days written notice after the activation period ends.

5. ROI Guarantee Terms

We guarantee positive ROI within your first 90 days. Here's how it works:

• If total revenue from RooferFuel-attributed appointments doesn't exceed your total spend (activation fee + base fees + appointment fees) within 90 days, your monthly base fee drops to $0
• Per-appointment fees remain active during the guarantee period
• Normal billing resumes when your cumulative revenue exceeds cumulative spend
• No back-billing for the months with waived base fees

Revenue attribution is determined by appointments booked through the RooferFuel platform that result in signed contracts, as verified through our tracking system.

6. Qualified Appointments

A "qualified appointment" is defined as a booked meeting with a homeowner who has expressed genuine interest in roofing services. Qualification is verified by our AI system based on the homeowner's stated needs, property details, and engagement level. Appointments that are no-shows, cancellations within 24 hours, or clearly unqualified leads are not charged.

7. Limitation of Liability

To the maximum extent permitted by law, RooferFuel.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amounts paid by you to RooferFuel.ai during the twelve months preceding the claim.

8. Termination

Either party may terminate the service agreement with 30 days written notice after the 90-day activation period. Upon termination, you will be billed for any outstanding appointment fees and the prorated base fee for the current billing period. Access to the platform and all RooferFuel-created assets will end at the conclusion of the notice period.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
